1. Services
Clima Smart, LLC provides HVAC and air conditioning services including, but not limited to: A/C maintenance, repairs, system replacements, installations, conversions, swaps, diagnostics, and preventative maintenance services. All services are subject to site conditions, equipment condition, material availability, and weather.
2. Estimates & Pricing
All estimates are based on visual inspections, measurements, and information provided by the customer. Estimates are not final until confirmed in writing. Prices may change if the scope of work, system condition, or material requirements differ from the original assessment.
3. Payment Terms
Payment terms will be specified on the invoice or estimate. Payment is due as stated unless otherwise agreed in writing. Failure to make timely payment may result in work delays, suspension of services, or additional fees.
4. Scheduling & Weather Conditions
Work schedules are subject to weather conditions. HVAC installation and service work may be affected by extreme temperatures, unsafe conditions, or other environmental factors. Clima Smart, LLC reserves the right to reschedule work due to weather or conditions beyond our control.
5. System Conditions & Limitations
Customer acknowledges that HVAC systems may have underlying conditions not visible at the time of estimate. Clima Smart, LLC is not responsible for failures caused by pre-existing damage, improper installation by third parties, electrical issues, ductwork defects, or structural limitations.
6. Customer Responsibilities
Customers are responsible for providing clear access to the work area, ensuring safe working conditions, and keeping people and pets away during service. Delays caused by lack of access may result in rescheduling or additional charges.
7. Warranty Disclaimer
Unless otherwise stated in writing, all services are provided without an express warranty. Normal wear, age-related failures, performance decline, and weather-related effects are not considered defects.
8. Limitation of Liability
Clima Smart, LLC shall not be liable for indirect, incidental, or consequential damages. Any liability shall not exceed the amount paid for the services performed.
9. Cancellations
Cancellations must be communicated in advance. Last-minute cancellations may result in a cancellation fee if labor, materials, or scheduling commitments have already been made.
10. Communication Consent
By providing your contact information, you agree to receive non-marketing communications related to estimates, scheduling, service updates, and invoices via phone, email, or text message.
